Encroachment/Right of Way Permits

The Public Works Department is responsible for inspecting all work done within street limits and the public right of way. An Encroachment Permit is required for any work done in or to the Public Right of Way. Please remember that in some cases, a pre-job inspection may be needed before a permit can be issued.

Some of the things that permits are needed for include:

  • Widening or replacing your driveway approach
  • Having a dumpster placed in front of your property
  • Landscaping work between the sidewalk and curb
  • Closing streets for block parties
  • Repairing your sewer connection to a city main

Requirements

Permits for work in the right of way are not over the counter permits. These permits require review and approval prior to work. It can take up to two weeks to be issued an encroachment permit, depending on the type work being done. Please plan accordingly. The following are general requirements to apply for a permit:

  1. Letter of request which includes:
    • Description of work to be done (i.e., boring, excavations, placing fiber optic cable, etc.)
    • Job Location (indicating whether work will be performed ON-SITE or OFF-SITE.
    • Three (3) sets of construction plans.
    • Work start date (or tentative start date).
    • Contractor Information
      • Contractor Name
      • Contractor mailing address
      • Contractor phone (office, cell, fax)
    • City of Buena Park Business License Number (Contact Finance at (714) 562-3736)
    • State Contractors License Number & Classification
  2. Approved Certificate of Insurance (Liability, Auto, Workers Compensation - for minimum requirements, click here)
  3. Signed permit conditions

Additional Requirements:

  1. Off-site work may require an approved Traffic Control Plan
    • When traffic control is required, three (3) sets of traffic control plans provided on 11" x 17" paper or larger are required and must conform to the current Watch Manual. Traffic Control plans will be reviewed and approved by the Traffic & Transportation Manager Prior to issuance of a permit. Traffic Control plans can take a maximum of two weeks for approval.

Geological Permits (new, maintenance, or operation of monitoring wells, soils boings, geo probing, hydro punch, Groundwater sampling, etc. require a Work Plan Site Assessment Letter from the Orange County Department of Health Care Agency (when applicable) and a plot plan (site location map 8 1/2" x 11") in addition to the requirements above. Off-Site Monitoring Well construction requires a license agreement. Please call the Engineering Services Division at (714) 562-3670 for more information.

Pre-Construction Meetings and Inspections

Contractors are required to schedule a pre-construction meeting in the field with a City Inspector, no less than 48-hours prior to the start of construction. In some cases a pre-construction meeting will be required prior to the issuance of a permit. Inspections for lane clsoures, excavations, detours, hauling, or final inspections require 24-hour notice. Oversized load truck haul Transportation Permits

A transportation permit is required to transport an oversized or overweight or transport special mobile equipment on city streets through the City of Buena Park. Transportation permits require an advance notice of 2 WORKING DAYS minimum. Variance permits can take longer due to advance approval. There a four (4) types of Transportation Permits:

  1. Single Trip Transportation Permit.
  2. Hauling Permit - for hauling construction debris. Additional requirements include:
    • If hauling dirt, the California Department of Food and Agriculture requires a Red Imported Fire Ant (RIFA) Compliance Agreement.
    • Hauling Permit Conditions
  3. Variance Permit - for Loads over 14' wide and 15'6" high.
    • Requires pre-approval from the Traffic and Transportation Manager - please allow a MINIMUM OF 2-5 WORKING DAYS.
  4. Annual Transportation Permits - a company can apply for an annual permit for multiple vehicles that are within legal limits. Additional requirements include:
    • Approved Certificate of Insurance (Liability, Auto, Workers Compensation - for minimum requirements, click here).
    • List of covered vehicles including make, model, size, weight, and license plate number.
